Welcome to Lumiea. These Terms of Service ("Terms") govern your use of our mobile application and services. By downloading, accessing, or using Lumiea, you agree to be bound by these Terms.

            Please read these Terms carefully before using our app. If you do not agree to these Terms, do not use Lumiea.
        

1. Acceptance of Terms

By creating an account or using Lumiea, you confirm that:

You are at least 13 years of age
You have read and understood these Terms
You agree to be bound by these Terms and our Privacy Policy
You have the legal capacity to enter into this agreement

2. Description of Service

Lumiea is a mobile application that provides:

AI-powered skin analysis using photo-based assessment
Personalized AM/PM skincare routines and weekly extras
Daily routine tracking with streaks and progress monitoring
Lifestyle and dietary recommendations for skin health
Badges, missions, and achievements for routine consistency

3. Account Registration

3.1 Account Creation

To use certain features, you must create an account using:

Email and password
Sign in with Apple
Sign in with Google

3.2 Account Responsibilities

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use
Providing accurate and complete information

4. Subscription & Payments

4.1 Free Features

Lumiea offers a free tier that includes your first skin analysis scan. Additional features require a Pro subscription.

4.2 Pro Subscription

The Pro subscription unlocks full access to personalized routines, unlimited scans, and all premium features. Pricing is displayed in the app.

4.3 Billing

All payments are processed through Apple's App Store or Google Play
Subscriptions automatically renew unless cancelled
You can cancel anytime through your device's subscription settings
No refunds for partial subscription periods

4.4 Price Changes

We reserve the right to change subscription prices. You will be notified in advance of any price changes.

5. User Content

5.1 Your Content

You retain ownership of content you create, including:

Skin photos you take for analysis
Profile information

5.2 License to Us

By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for providing and improving our services. Skin photos are automatically deleted after analysis.

5.3 Prohibited Content

You may not upload content that:

Violates any law or regulation
Infringes on intellectual property rights
Contains malware or harmful code
Is offensive, abusive, or inappropriate

6. Acceptable Use

You agree NOT to:

Use the app for any illegal purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the service
Reverse engineer or decompile the app
Share your account with others
Use the app to harm or harass others
Circumvent any security features

7. Health & Medical Disclaimer

Important Health Notice:

Lumiea provides skincare information and routine suggestions for educational and informational purposes only. This app is NOT a substitute for professional medical advice, diagnosis, or treatment by a dermatologist or other qualified healthcare provider.

7.1 Consult a Dermatologist

You should:

Consult with a qualified dermatologist for persistent skin concerns
Seek professional advice before starting new skincare products, especially if you have sensitive skin or allergies
Not rely solely on AI analysis for diagnosing skin conditions

7.2 AI Analysis Limitations

AI skin analysis provides general guidance and may not detect all skin conditions
Results are not a medical diagnosis
Product and ingredient recommendations are general suggestions, not prescriptions
We are not liable for any adverse reactions from following routine suggestions

8. Intellectual Property

8.1 Our Rights

All rights, title, and interest in Lumiea, including but not limited to:

Software code and architecture
User interface design
Skincare content and methodologies
Trademarks and logos
AI models and algorithms

are owned by us or our licensors.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

9. Termination

9.1 By You

You may terminate your account at any time by:

Cancelling your subscription through your device's subscription settings
Deleting your account in the Profile section of the app
Contacting our support team

9.2 By Us

We may suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent activity
Abuse the service or other users

9.3 Effect of Termination

Upon termination:

Your access to premium features will end
Your data may be deleted per our Privacy Policy
Certain provisions of these Terms survive termination

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy of AI skin analysis
Uninterrupted or error-free service

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or goodwill
Personal injury or adverse skin reactions
Any damages exceeding the amount you paid us in the past 12 months

12. Indemnification

You agree to indemnify and hold harmless Lumiea, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

Your use of the service
Your violation of these Terms
Your violation of any third-party rights
Your user content

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing any legal claim, you agree to try to resolve the dispute informally by contacting us.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

Updating the "Last Updated" date
Sending an in-app notification
Requiring acceptance of new Terms

Continued use after changes constitutes acceptance of the new Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Lumiea.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 Waiver

Our failure to enforce any right does not waive our ability to enforce it later.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to an affiliate or successor.

These Terms are between you and Lumiea, not Apple
Apple has no obligation to provide maintenance or support

Apple is a third-party beneficiary of these Terms
